TERMS & CONDITIONS (ONTARIO, CANADA)

1. Authorization to Proceed

I confirm that I am the owner of the property or have full authority to authorize the plumbing work described in this agreement. I hereby authorize Drain 1 Plumbers Inc. (“the Contractor”) to perform the work as outlined and agree to all terms and conditions contained herein.

 

2. Pricing, Additional Work & Unforeseen Conditions

I understand and agree that the initial price quoted prior to the commencement of work applies only to the work specifically described. The quoted price does not include additional labor, materials, or services required due to unforeseen, concealed, or pre-existing conditions, including but not limited to damaged, corroded, non-code-compliant, inaccessible, or deteriorated plumbing components.

Any additional work required to safely or properly complete the job may result in additional charges, which will be communicated when reasonably possible.

 

3. Existing Systems & Limitation of Liability

I acknowledge that plumbing systems, drains, sewer lines, and fixtures may be aged, corroded, fragile, or improperly installed. I agree to hold Drain 1 Plumbers Inc., its employees, subcontractors, and assigns harmless for any failure, breakage, or malfunction of existing parts or systems that are deemed corroded, unusable, unreliable, or unsafe during the course of work.

The Contractor shall not be responsible for damage to pre-existing or concealed conditions that were not reasonably visible prior to commencement of work.

 

4. Emergency Service Authorization

For emergency plumbing services, I understand that work may begin immediately upon authorization, verbal or written, to prevent further damage. By requesting emergency service, I waive the requirement for a written estimate prior to commencement and accept all applicable emergency service rates and charges.

 

5. Access, Property Conditions & Restoration

I agree to provide safe, clear, and reasonable access to the work area. The Contractor is not responsible for delays or additional costs caused by restricted access, unsafe conditions, or third-party interference.

Where necessary to complete the work, cutting, opening, or removal of walls, floors, concrete, cabinetry, or other finishes may be required. Drain 1 Plumbers Inc. is not responsible for cosmetic repairs, restoration, or refinishing unless expressly stated in writing.

 

6. Permits & Code Compliance

Where required and agreed upon, work will be performed in compliance with applicable Ontario Building Code requirements. Unless explicitly included in writing, permit fees, engineering reports, inspections beyond plumbing scope, or third-party approvals are not included.

 

7. Warranty & No Warranty on Existing Materials

New materials and workmanship are warranted only to the extent provided by the manufacturer and applicable law. No warranty is provided for existing plumbing systems, drains, sewer lines, or materials not supplied by Drain 1 Plumbers Inc. Failures caused by age, corrosion, misuse, ground conditions, root intrusion, or municipal infrastructure are excluded.

 

8. Flood Prevention & Insurance Disclaimer

I acknowledge that plumbing repairs, drain cleaning, sewer work, sump pumps, and backwater valves reduce risk but do not guarantee prevention of flooding or sewer backups. The Contractor makes no representation regarding insurance coverage. It is the customer’s responsibility to confirm coverage with their insurer.

 

9. Payment Terms

Payment is due upon receipt of the invoice unless otherwise agreed to in writing. Any balance not paid within 10 calendar days of the invoice date will be subject to a monthly service charge of 1.5% (18% per annum), calculated from the invoice date until paid in full.

 

10. Construction Lien Rights (Ontario)

In accordance with the Construction Act (Ontario), Drain 1 Plumbers Inc. reserves the right to register a construction lien for unpaid services, labor, or materials supplied to the property.

 

11. Cancellation & Refusal of Service

The Contractor reserves the right to stop work or refuse service due to unsafe conditions, non-payment, abusive behavior, or failure to provide access. Any completed work and incurred costs remain payable.

 

12. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario, Canada.

 

13. Acceptance

By authorizing work, signing, or allowing work to proceed, I confirm that I have read, understand, and agree to all terms and conditions listed above.
